What Is a DOT Drug & Alcohol Testing Program?
Federal regulations require all CDL drivers subject to FMCSA jurisdiction to participate in a random drug and alcohol testing program managed by a C/TPA — a Consortium/Third-Party Administrator. The program includes pre-employment testing, random testing throughout the year, and post-accident testing when required.
If you are an owner-operator with no employees, you still must be enrolled in a consortium that manages your random testing pool.
What Happens If You're Not Enrolled?
An FMCSA auditor will ask for proof of consortium enrollment and your pre-employment drug test result on day one of your New Entrant Safety Audit. If you cannot produce both, you fail. There is no grace period for this violation.
Operating without a compliant testing program is also a direct violation of 49 CFR Part 382 and can result in your authority being placed out of service.

A random pool is a group of drivers from which a percentage are randomly selected for drug and alcohol testing throughout the year. As an owner-operator enrolled in a consortium, you are part of a shared pool managed by the C/TPA.
