FMCSA Audit Documents Checklist: Every File You Need Organized by BASIC Category
The investigator works from a checklist. So should you. Here is the complete document checklist organized by audit category. Print it. Build a binder with one tab per category. Walk every line and mark it complete before the audit notice arrives.
Category 1: Driver qualification (49 CFR Part 391)
One file per driver, including the owner-operator if they drive. Contents:
- Employment application meeting 49 CFR 391.21
- Copy of CDL with class and endorsements matching the vehicle
- Initial MVR within 30 days of hire, then annual MVR (49 CFR 391.25)
- Annual driver review certification (49 CFR 391.25)
- Current medical examiner's certificate and the National Registry verification
- Road test certificate or equivalent (49 CFR 391.31)
- Three-year previous employer safety performance history (49 CFR 391.23)
- Negative pre-employment drug test result
- Pre-employment Clearinghouse full query result with driver consent
- Most recent annual Clearinghouse limited query result
Category 2: Drug and alcohol testing (49 CFR Part 382)
- Consortium / TPA enrollment letter dated before first dispatch
- FMCSA Clearinghouse employer registration
- FMCSA Clearinghouse driver registration for every CDL driver
- Written drug and alcohol policy meeting 49 CFR 382.601
- Signed acknowledgment of receipt by every driver
- Designated Employer Representative (DER) named in writing
- Supervisor reasonable suspicion training certificate (60 minutes drugs, 60 minutes alcohol)
- Random selection records from the consortium
- All test results: pre-employment, random, post-accident, reasonable suspicion, return-to-duty, follow-up
- MRO verification on each result
Category 3: Hours of service and ELDs (49 CFR Part 395)
- ELD device registration listed at csa.fmcsa.dot.gov/ELD
- ELD user manual and malfunction instructions in each cab
- Six months of driver duty status records
- Eight categories of supporting documents per driver per 24-hour period for six months
- Driver log audit records showing weekly review
- Any short-haul exception qualification records (if used)
- Personal conveyance and yard moves documentation policy
Category 4: Vehicle maintenance (49 CFR Part 396)
One file per vehicle, kept for the life of the vehicle plus six months.
- Vehicle identification record (year, make, VIN, registration, owner)
- Written maintenance program
- Annual inspection report (49 CFR 396.17) within last 12 months
- Driver Vehicle Inspection Reports (DVIRs) for last 90 days
- Repair invoices and certification that defects were corrected
- Documentation of driver inspector qualifications if internal
- Brake records and adjustment history
Category 5: Insurance and authority (49 CFR Parts 387 and 365)
- Certificate of insurance current and meeting federal minimums
- BMC-91 or BMC-91X liability filing confirmation
- MCS-90 endorsement on the policy
- Cargo coverage if required by your authority (BMC-32)
- BOC-3 process agent designation filing confirmation
- UCR registration confirmation for the current year
- MC and DOT number certificates
- Current MCS-150 within the last 24 months
Category 6: Accident register (49 CFR 390.15)
- Written accident register listing all DOT-reportable accidents in the last three years
- Cover page stating zero accidents if applicable
- Police reports and accident reports for every entry
- Post-accident drug and alcohol test results (49 CFR 382.303)
- Insurance claim records for each accident
Category 7 (HM only): Hazardous materials
- Hazardous Materials Registration
- HM security plan (49 CFR Part 172 Subpart I) if required
- HM training records for every employee handling HM
- Shipping papers and emergency response information
Organize and label everything
Use one folder per category. Name files consistently: 'Smith_John_DQ_MVR_2026-04-12.pdf' is better than 'scan001.pdf.' Investigators reviewing dozens of carriers per week reward organization.
